Deed Agreements

HELVIA FIDUCIAIRE keeps the asset according to the agreed rules, delivering it exclusively to the beneficiary or depositor, given the conditions established in the contract have been met.

HELVIA FIDUCIAIRE strictly adheres to the instructions given by the main parties and provides regular reports to them with regard to the escrowed assets. If they are interest-bearing assets, HELVIA FIDUCIAIRE also administers them as requested.

The Escrow services of HELVIA FIDUCIARIE are flexible and lend themselves to multiple uses, including:

• The fulfillment of obligations arising from the application of international trade contracts, especially when the conditions of reliability and solvency of the debtor are difficult to verify;
• The settlement of contracts for the realization of works or manufactured goods, commissioned by a foreign client to a domestic producer. HELVIA FIDUCIAIRE will keep the agreed consideration and will pay it to the domestic manufacturer only after the delivery of the good or at the end of the work, after verification of its workmanship according to the agreed criteria;
• The fulfilment of the lessee's obligations within the framework of contracts for the leasing of movable and immovable property and also of financial leases;
• The settlement of disputes with reference to the ownership of deposited goods;
• The payment of a penalty upon the occurrence of certain conditions;
• The subrogation of the pledge and the guarantee of anonymity in cases of financing guaranteed by credit institutions;
• Financing in favor of holding companies wishing to finance their subsidiaries, avoiding the creation of a pledge on shareholdings and the related registration tax..
